The Designation of the “Expiration Date” Under the Professional Investor System

We hereby announce that the expiration date related to the transition system for Professional Investor under the Financial Instruments and Exchange Law (the “Law”) shall be set as follows:

Expiration Date: End of June each year
(Inclusive of non-business day of our company.)

  • Under the Law, customers are classified as either "Professional Investor" or "customers other than Professional Investor" (hereinafter referred to as “General Investor”) for each "type of contract" (as defined in Article 53 of the Cabinet Office Ordinance on Financial Instruments Business, etc.; the same shall apply hereinafter).
  • Where customers are categorized as Professional Investor under the Professional Investor System, the financial instruments business provider may be exempted from some of its obligations, such as delivering documents that explain risks to General Investor before entering into the relevant contract.
  • The Law permits customers to transfer from "Professional Investor" to "General Investor" or vice versa, subject to a request from the customer and approval from our company following the prescribed procedures, for each "type of contract." Please note that we may decline a request for the transition from "General Investor" to "Professional Investor" based on the results of our internal review.
  • The validity period for the transition from "General Investor" to "Professional Investor" is, in principle, one year. However, our company designates the end of June (including non-business days) following the date on which the customer transitions to a Professional Investor as the expiration date.
  • The customer who transferred to a "Professional Investor" will automatically revert to "General Investor" status after the expiration date. If the customer wishes to remain a "Professional Investor" beyond the expiration date, it is necessary to submit a new request. (Automatic renewal is not available.) Our company will notify eligible customers prior to the expiration date regarding the reapplication process.

This notice is disclosed in accordance with Article 34-3, Paragraph 2 and Article 34-4, Paragraph 6 of the Financial Instruments and Exchange Law, and Articles 58 and 63 of the Cabinet Office Ordinance.

Please note that this document is not intended to solicit the continuation of Professional Investor status for customers who have already transitioned to such status.
